Welcome to EverLume. These Terms of Service (“Terms”) govern your access to and use of our website, and your purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully.

1. About Us

EverLume is an online store offering personalised photo-projection jewellery, operating within South Africa. If you have any questions about these Terms, please contact us at support@ever-lume.co.za.

2. Eligibility

By using our website and placing an order, you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian to make a purchase.

3. Products and Personalisation

• Our products are custom-made using photos and personal details you provide.

• You are responsible for ensuring that any photo or content you submit is your own, that you have the right to use it, and that it does not infringe on the rights of any third party.

• You confirm and approve all personalisation details (including photos, text, and colour selections) before your order is submitted for production. Please review these carefully, as production begins shortly after purchase.

• We reserve the right to refuse or cancel any order containing content that is offensive, unlawful, infringes on intellectual property rights, or is otherwise inappropriate, at our sole discretion.

4. Product Descriptions and Images

We do our best to display our products, colours, and finishes as accurately as possible. However, slight variations may occur due to screen settings, lighting, or the handmade nature of certain finishing processes. Product images (including lifestyle and projection imagery) are for illustrative purposes and may not represent exact scale.

5. Pricing and Payment

• All prices are listed in South African Rand (ZAR) and are inclusive of applicable South African taxes, unless stated otherwise.

• We reserve the right to change prices at any time without prior notice; however, the price at the time you place your order will be honoured.

• Payment must be received in full before production of your order begins.

• We use secure third-party payment providers to process transactions. EverLume does not store your full payment card details.

6. Order Acceptance

Your order constitutes an offer to purchase. We reserve the right to accept or decline any order at our discretion, including in cases of suspected fraud, pricing errors, or stock/production limitations. If we are unable to fulfil your order, you will be notified and refunded in full.

7. Shipping and Delivery

Please refer to our Shipping Policy for detailed information on production and delivery timeframes, which is incorporated into these Terms by reference.

8. Returns and Refunds

Because our products are personalised and made to order, they are generally not eligible for return or refund, except as set out in our Return and Refund Policy, which is incorporated into these Terms by reference.

9. Intellectual Property

All content on our website, including the EverLume name, logo, wordmark, tagline “A Memory You Can Wear,” product designs, graphics, and imagery, is the property of EverLume and may not be copied, reproduced, or used without our prior written permission.

By submitting a photo for personalisation, you grant EverLume a limited licence to use that image solely for the purpose of producing and fulfilling your order, and (with your separate consent only) for marketing purposes if you choose to share your experience with us.

10. Limitation of Liability

To the fullest extent permitted by law, EverLume shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or products. Nothing in these Terms limits any liability that cannot be excluded under South African law, including your rights under the Consumer Protection Act 68 of 2008.

Our jewellery pieces contain small components and are not suitable for children under the age of 3 years, due to choking hazards. Please supervise young children around jewellery items.

11. Website Use

You agree not to use our website for any unlawful purpose, to attempt unauthorised access to our systems, or to interfere with the proper functioning of our website.

12. Privacy

Any personal information you provide to us, including photos submitted for personalisation, is handled in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). We use your information solely to process and fulfil your order and to communicate with you about your purchase, unless you have separately consented to marketing communications.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of our website shall be subject to the jurisdiction of the South African courts.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal reasons. The updated Terms will be posted on this page with a revised “Last updated” date. Continued use of our website after changes are posted constitutes acceptance of the revised Terms.
